Juicio por el crimen de Carlos Cordero: Se escucharon los alegatos y ahora sólo resta conocer la sentencia
El juicio por el crimen de Carlos Cordero entró en su etapa final y ahora sólo resta ahora que las juezas que integran el Tribunal Oral y Criminal N° 2 dicten la sentencia por el aberrante crimen que tiene como acusados a un hombre y una mujer, que se encuentran detenidos.
En este juicio el TOC N° 2, con asiento en el Palacio de Justicia de Azul estuvo integrado por las doctoras Alejandra Raverta, Inés Haydeé Olmedo y Silvia Araceli Torres. Uno de los datos para resaltar es que debido a las vacancias en el Poder Judicial, sólo la doctora Raverta es la jueza natural dado que las otras dos son subrogantes.
La última audiencia, después de muchas en las que se escucharon importante cantidad de testimonios, estuvo centrada en los alegatos que desarrollaron las partes que intervinieron en el proceso. La acusación estuvo a cargo de la fiscal Paula Serrano y la defensa de los imputados la llevaron adelante dos Defensoras Oficiales del Departamento Judicial Azul. La doctora Soledad Kelly defendió al imputado Claudio «El Chaco» Ibarra y la doctora Adriana Hernández hizo lo propio con Anabela Landalde.
La sentencia por este aberrante crimen se conocerá el 10 de diciembre próximo a las 13 horas.
Los alegatos
En la última audiencia, desarrollada en Azul, la fiscal Paula Serrano centró su alegato en ubicar a los dos imputados como responsables del crimen. Para la representante del Ministerio Público tanto Ibarra como Landalde son responsables del delito de homicidio agravado por la alevosía y el uso de arma de fuego tal como está establecido en el Art. 80 Inc. 2 y 41 bis del Código Penal de la Nación.
En este sentido, para Paula Serrano «El Chaco» Ibarra fue el autor del crimen mientras que Anabela Landalde actuó como participe primaria.
De prosperar la acusación tanto Ibarra como Landalde podrían ser condenados a la pena máxima: prisión perpetua.
De todas maneras, la doctora Paula Serrano planteó una pena «subsidiaria» para la imputada Landalde dado que pidió 15 años de prisión en el supuesto que las jueces consideran que actuó en el crimen como participe secundaria.
En el desarrollo de los alegatos las Defensoras Oficiales Kelly y Hernández pidieron la absolución de Ibarra y de Landalde.
En esos alegatos se escuchó que no existen pruebas de que Ibarra y Landalde hayan participado del homicidio de Cordero. Si bien en el expediente judicial existe una foto de Ibarra junto al cuerpo de Cordero, eso no es prueba para achacarle el crimen al imputado. La doctora Kelly dejó planteado además que durante el juicio se planteó un «sesgo de género» dado que se habría intentado señalar que Landalde, por su condición de mujer, no podía haber asesinado y descuartizado a Cordero.
La doctora Kelly – en defensa de Ibarra – asumió ante las juezas y en su alegato la posibilidad de que Ibarra haya cometido «encubrimiento» con intención de proteger a Landalde.
Por su parte, la doctora Hernández en calidad de defensora de Landalde señaló que la mujer era víctima de violencia de género, por parte de Ibarra, razón por la cual se pidió la absolución dado que no se habría podido probar que la mujer hubiese participado de ninguno de los delitos.
Tanto para Kelly como para Hernández durante el juicio no se probó la alevosia.
