Eximen de responsabilidad a la Municipalidad de Olavarría tras un trágico accidente de tránsito
Quien demandó al Estado Municipal adujo que el siniestro vial que terminó con la vida de una mujer, entre otras cosas, se produjo por el deficiente estado de iluminación de la rotonda de Avellaneda y Circunvalación
Un juez liberó de responsabilidades a la Municipalidad de Olavarría en el marco de una demanda iniciada en el fuero Contencioso Administrativo de la ciudad de Azul por un accidente de tránsito que se produjo en la rotonda de Avellaneda y Circunvalación.
Se trata de un litigio de larga data que encontró sentencia, de primera instancia, en los primeros días del mes de septiembre.
Si bien la sentencia de grado fue apelada, en esta primera instancia la razón recayó en el Estado Municipal.
La génesis de la sentencia
El jueves 27 de septiembre de 2011, poco después de la medianoche, se produjo un siniestro vial en la rotonda de Avellaneda y Circunvalación. En ese hecho, el olavarriense Francisco José Tartuferi conducía un automóvil Renault 21 Break y viajaba acompañado por la señora Mirta Beatriz Lunati.
Según se desprende del relato de los hechos en la demanda judicial, el automóvil en cuestión circulaba desde Loma Negra hacia Olavarría cuando termina impactando con violencia contra la rotonda ubicada en Avellaneda y Circunvalación.
Debido a la violencia del impacto, Mirta Lunati falleció y Tartuferi resultó gravemente herido.
Al demandar al Municipio y con el objetivo de hacerlo responsable del siniestro, Francisco José Tartuferi señaló que se encuentra en «forma sorpresiva y repentina» con la rotonda «a consecuencia de la escasa y deficiente iluminación y ante la falta de una correcta señalización y/o individualización.»
Los abogados que llevan adelante la demanda contra la Municipalidad de Olavarría son los doctores Oscar Arnaldo Palay y la Dra. Guadalupe Belén Laborde quien además señalaron que la zanja que atraviesa la rotonda, «es ancha y profunda y con agua, sin estar debidamente cubierta para evitar este tipo de accidentes por el riesgo que representa la misma.»
Describieron además que en el momento del accidente de las seis luminarias ubicadas en el lugar tan sólo funcionaban tres y aseguran que por como está diagramada esa rotonda, «no da posibilidad de maniobra evasiva o elusiva alguna» de manera tal que el conductor del auto siniestrado no pudo reducir la velocidad del impacto.
Al momento de presentarse en la demanda, la Municipalidad de Olavarría señaló que al momento del trágico accidente «existía una señalización suficiente del lugar que un conductor prudente no debería haber desconocido.»
Para la Municipalidad en el siniestro la responsabilidad fue del conductor del rodado dado que «indefectiblemente debió ir a alta velocidad, o ser manejado con notable impericia.»
La postura de la Justicia
La sentencia que favoreció a la Municipalidad de Olavarría fue dictada en los primeros días del mes de septiembre y lleva la firma del doctor Pablo Quaranta, titular del Juzgado Contencioso Administrativo N° 1 con sede en la ciudad de Azul.
En Línea Noticias accedió al texto de la sentencia en donde el Magistrado azuleño rechaza la demanda y no hace lugar a la demanda de resarcimiento que pretendía quien inició las acciones.
El titular del Juzgado Contencioso Administrativo de Azul indica en la sentencia que el accidente de tránsito que fue motivo de demanda contra la Municipalidad, «estuvo determinado por aspectos que provienen del obrar de la víctima (…) que desencadenaron el despiste y pérdida de control del automotor, a una velocidad superior a los límites de velocidad establecidos por las leyes de tránsito, los cuales es imperioso respetar para evitar la producción de siniestros cuyos desenlaces resultan productores de daños de costosa y difícil [como los daños patrimoniales y extrapatrimoniales generados al actor] o bien, de imposible reparación [como es el caso del fallecimiento de la acompañante del Sr. Tartuferi].«
Centralmente, el juez Quaranta señala que «la presencia de la rotonda situada en la intersección de las Avenidas Avellaneda y Eva Perón de la ciudad de Olavarría se encontraba señalizada e iluminada al tiempo del lamentable evento por el cual se reclaman, influyendo como decisivo factor en su producción el obrar humano en la conducción dado por circular a una velocidad excesiva en relación a la permitida que determinó la pérdida de control del automóvil y el posterior desenlace que culminó en el fallecimiento de la Sra. Lunatti.»
En la demanda contra el Municipio se había intentado señalar que tras el accidente, el Estado Municipal realizó una serie de obras en el sector de la rotonda ubicada en Circunvalación y Avellaneda. Esto fue mencionado en la sentencia aunque el Juez dejó dicho: «en muchos casos con ulterioridad a la data del siniestro (…) se realizaron -entre otras- obras de pavimentación y señalización de la intersección donde se ubica la rotonda, ello es demostrativo de la ocupación del Municipio demandado en mejorar un área de la ciudad donde ocurrieron accidentes con un claro objetivo de evitarlos en el futuro y de brindar mayor seguridad a los conductores. No obstante, ello no resulta suficiente para determinar que, al tiempo del hecho, no existía la señalización e iluminación suficiente que alerte la presencia de la rotonda…»
La sentencia dictada por el Juez Quaranta se encuentra ahora en estudio en la Cámara de Apelaciones en lo Contencioso Administrativo de la ciudad de Mar del Plata.
