Tandil: Gravísima denuncia contra un Juez, un empresario, una escribana y al menos dos abogadas
En las últimas horas las declaraciones de un reconocido abogado sacudieron a la ciudad de Tandil y a todo el Departamento Judicial de Azul.
El abogado Julio Ballesteros, conocido en su momento por representar a Guillermo Coppola en la causa de los jarrones y titular de un conocido bufete de Buenos Aires, denunció una red de complicidades que involucran a un empresario, una Escribana, dos abogadas y un Juez Civil y Comercial con despacho en la ciudad de Tandil.
El abogado Julio Ballesteros habló con Lu22, Radio Tandil, y dio detalles muy precisos de una causa judicial que ahora tramita en la UFI de Delitos Especiales del Departamento Judicial de Azul.
Todo se inició en la disputa de una chacra ubicada entre el Paseo Centinela y La Porteña en la ciudad de Tandil.
Según se indica los propietarios de esa tierra cedieron oportunamente sus derechos hereditarios a un grupo de desarrolladores inmobiliarios que emprendieron una obra en el lugar, pero no pudieron continuarla por medidas judiciales que ellos consideran parte de una maniobra de extorsión, y por las cuales iniciaron una causa penal.
El abogado Julio Ballesteros explicó que sus clientes, hoy denunciantes, son los desarrolladores que se encontraron con «palos en la rueda» para continuar con la inversión.
Con respecto a la resolución judicial, Ballesteros dijo que «a los cesionarios, a quienes estaban desarrollando el emprendimiento, les dieron una patada en el traste y los echaron por una decisión judicial, absolutamente ilegítima e infundada, como lo decimos en la querella».
«Hoy la justicia especial con sede en la ciudad de Azul (Fiscalía de Delitos Especiales) está tramitando esta querella, en la que hemos imputado formalmente por delito de extorsión al empresario Luis Cerone, a dos abogadas, a una escribana que suscribió y materializó un poder que creemos que no reúne las características que debe tener, y a un magistrado, juez civil y comercial, que es el doctor Zárate, a quien consideramos cómplice de la tentativa de desapoderar a los verdaderos tenedores, poseedores y desarrolladores, a través de resoluciones que, a nuestro juicio, constituyen delito», indicó luego.
«Ahí, muchos años antes, un señor se instaló en una plaza, en un sectorcito que es propiedad del municipio. Y a partir de allí empezó, con la colaboración de quien nosotros hemos imputado, el señor Cerone, a ejercer presiones con respecto a eventuales títulos jurídicos que podía llegar a tener pero que no los tiene. Esto empezó en 2012, con un poder efectuado en favor de una abogada por este señor, que nosotros consideramos que no tiene capacidad; un poder bastante raro», señaló el abogado.
A partir de esta medida, hubo una medida cautelar y, según Ballesteros, se «desalojó a los poseedores». El abogado se refirió a exigencias por parte de los abogados y «cosas inauditas» que asegura, pese a los años de profesión, nunca haber visto. «Es un caso muy particular que para mí tiene circunstancias inauditas», insistió.
Habló de acciones «contrarias a derecho» con «el fin de amedrentar a las personas para que otorguen un dinero que nunca iban a aceptar, porque el objetivo de todo este grupo de personas era, o es, el predio», arriesgó el letrado.
Ballesteros aseguró que los abogados pedían para el ocupante, a quien calificó de indigente, 500 mil dólares y otros 100 mil dólares de honorarios para los abogados.
«A mis clientes no solamente les parecía una locura lo que se exigía, sino que no estaban en condiciones de solventar semejante cosa. Y además no correspondía», añadió.
«El segundo paso fue la intervención judicial y ahí ya se asustaron verdaderamente», dijo luego para justificar la querella iniciada por extorsión en Azul.
«La fiscalía que salió sorteada en primer término fue la Fiscalía Nº 8 de Tandil, pero como había un funcionario público denunciado, le dieron intervención a la Fiscalía Nº 24, que es especializada. El jueves estuve en la fiscalía porque no tenemos acceso al expediente», explicó.
«La secretaria de la fiscalía nos atendió muy cordialmente y nos dijo que está avanzando la investigación y que algunas partes se han presentado a tomar conocimiento del hecho», concluyó.
